Abstract (English):
Introduction: examines the issues of the lack of progress in the development of operational investigative law with regard to the interaction between operational investigators and the judiciary. It emphasizes the difficulties that arise in the work of operational units within law enforcement agencies in detecting and preventing crimes, as well as ensuring human and civil rights, due to legislative backwardness. Materials and methods: The normative basis for the study is provided by repealed laws of the Russian Federation, federal laws in the field of operational investigation law, local regulations of state authorities, and the established practice of the Supreme Courts of the Russian Federation. The methodological basis for the research is the general dialectical method of scientific cognition, which is universal in nature. Other methods used include generalization and description, observation, comparison, and analysis. The Results of the Study: indicate that the lack of regulation of operational investigative procedures is a significant issue that requires immediate attention from the legislature. As part of our analysis, we have identified several gaps in the current operational investigative laws that need to be addressed. One of the proposed solutions is to increase the speed of updating the Federal Law on Operative Investigative Activities. Findings and Conclusions: of this study have led to the formulation of some recommendations for developing new approaches to the updating of operational investigative legislation. These recommendations aim to ensure that operational investigative procedures are conducted in a way that respects human and civil rights and freedoms while effectively combating crime.
