COMPARATIVE ANALYSIS OF RESPONSIBILITY FOR SUBVERSIVE CRIMES UNDER THE LEGISLATION OF FOREIGN COUNTRIES

Abstract (English):
Introduction: the article examines and compares the norms of the criminal legislation of certain foreign countries, which establish responsibility for crimes of sabotage as one of the most dangerous crimes that endanger the internal security of any state, regardless of its political and territorial structure. Materials and Methods: the materials of the study were the doctrine of criminal law, devoted to foreign legislation in the field of legal assessment of the establishment of criminal liability for sabotage (sabotage) and related crimes, the norms of foreign criminal legislation, represented by criminal legal acts of countries near and far abroad. The methodological basis of the study was a combination of general scientific and private scientific research methods. System analysis and synthesis, analogy, induction, deduction, generalization, and comparison were used as general scientific methods. Specialized private scientific methods were: formal-legal, comparative-legal, systemic-structural, structural-multifunctional. The Results of the Study: Through the conducted research, it was possible to compare the criminal law mechanisms for establishing responsibility for subversive crimes, to identify the features of constructing objective and subjective signs of these crimes, which arouse reasonable interest and may later be reflected in the Russian criminal law. Findings and Conclusions: the analyzed norms of the criminal codes of a number of foreign countries made it possible to reveal the specifics of the criminal law regulation of responsibility for crimes of sabotage, compare them and establish a number of their distinctive features.
