INDIVIDUALIZATION OF THE APPLICATION OF DEFERRAL OF SERVING A SENTENCE: ACCOUNTING FOR THE MENTAL AGE OF A MINOR AND THE LIMITS OF INTERPRETATION OF ARTICLE 82 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract:
Introduction: In the context of the ongoing development of the principles of humanism and individualization of criminal liability, particular significance is attached to the mechanism of deferral of serving a sentence, the application of which requires consideration not only of formally established criteria but also of the factual circumstances characterizing the situation of a minor dependent on the convicted person. Materials and Methods: The methodological framework of the study is based on formal-legal, systemic, and comparative legal approaches. The empirical basis comprises the provisions of the criminal legislation of the Russian Federation, relevant judicial practice, and scholarly works addressing the individualization of criminal liability. The Results of the Study: The study demonstrates that the current wording of Article 82 of the Criminal Code of the Russian Federation, grounded in a rigid age criterion, does not always ensure adequate consideration of the actual degree of a minor’s dependence on the convicted person. A comparison with the provisions of Article 96 of the Criminal Code reveals the existence of a legal approach that allows for taking into account the individual’s actual level of development beyond their chronological age. The analysis of judicial practice indicates an emerging tendency toward assessing the individual characteristics of the offender; however, such approaches have not yet been extended to the application of deferral of serving a sentence. Findings and Conclusions: The study substantiates the need to expand the individualizing potential of Article 82 of the Criminal Code of the Russian Federation by introducing an exceptional mechanism permitting consideration of the mental age of a minor in cases where this is justified by the minor’s actual condition and best interests. It is concluded that a more flexible model of law enforcement may be developed without undermining the requirements of legality and legal certainty.
