Abstract: in the context of the development of domestic tourism in the Russian Federation, the issues of safety of the provided transfer and other tourist services using water and air transport are extremely relevant. In practice, we see that the more the tourist infrastructure develops in certain regions that are most attractive to tourists, the more so-called "gray" carriers there are who use water and air transport for entertainment and tourist purposes without observing the norms of current legislation. This article provides data on the problems that law enforcement officers face when deciding whether to initiate criminal cases of this category.
