В статье рассматриваются сложившиеся в следственно-судебной практике подходы к определению виновных лиц за нарушение правил безопасности при ведении строительных работ, повлекшие тяжкие последствия. Первоначально автором определяется правовой статус лиц, подлежащих уголовной ответственности за нарушение требований безопасности в строительстве, и резюмируется его ограничение профессиональными участниками строительной сферы. Дальнейшая конкретизация личность преступника осуществляется исходя из требований следственно - судебной практики, устанавливающих в качестве обязательного критерия объективной стороны преступления, наличие прямой связи между допущенными нарушениями и наступившими последствиями. Также учитываются личности потерпевших в большинстве случаев, которыми являются рядовые рабочие строители. Делается вывод о наиболее характерных управленческих должностях, виновных в допущении несчастных случаев в строительстве - бригадир, мастер и прораб. Дается оценка роли нарушений, допущенных самим пострадавшим, приводятся рекомендации по действиям должностных лиц и непосредственных работников по обеспечению предупреждения травматизма в строительстве.
The article examines the approaches to determining the perpetrators of violations of safety rules during construction work that have led to serious consequences in investigative and judicial practice. Initially, the author defines the legal status of individuals subject to criminal liability for violations of safety requirements in construction and summarizes its limitation to professional participants in the construction industry. Further specification of the perpetrator's identity is based on the requirements of investigative and judicial practice, which establish a direct link between the violations committed and the resulting consequences as a mandatory criterion for the objective aspect of the crime. The identities of the victims, who are mostly ordinary construction workers, are also taken into account. The most common management positions responsible for construction accidents are the foreman, the master, and the supervisor. The role of the offender is assessed. The article examines the approaches to determining the perpetrators for violations of safety rules during construction work that led to serious consequences, which have been established in investigative and judicial practice. The article assesses the role of violations committed by the victim and provides recommendations for the actions of officials and direct employees to prevent injuries in construction.
