В статье рассматриваются особенности оперативной и следственной работы по преступлениям, связанным с незаконными рубками лесных насаждений. Особое внимание автора уделено прикладному аспекту проведения оперативно - розыскных мероприятий и следственных действий в зависимости от конкретного вида рассматриваемого состава преступления. Предметом исследования являются отдельные проблемные аспекты деятельности по раскрытию и расследованию преступлений, предусмотренных ст. 260 УК РФ. Необходимость совершенствования указанного направления работы органов внутренних дел обусловлена несовершенством правовой базы с одной стороны и повышенным криминальным вниманием к незаконной рубке лесных насаждений – с другой. Научная новизна данной работы состоит в выявлении проблемных аспектов уголовного, уголовно-процессуального и оперативно - розыскного законодательства в сфере противодействия незаконным рубкам лесных насаждений. Автором приводятся различные категории незаконных рубок лесных насаждений и на основе этого предлагаются конкретные оперативно - розыскные и уголовно-процессуальные меры противодействия данным преступлениям. По результатам исследования автором сделан вывод о том, что специфика каждой рассматриваемой группы обусловливает выбор тактики проведения оперативно-розыскных мероприятий и процессуальных действий для выявления, предупреждения, пресечения и раскрытия таких преступных деяний.
The article discusses the features of operational and investigative work on crimes related to illegal logging. The author pays special attention to the applied aspect of carrying out operational-search activities and investigative / procedural actions, depending on the specific type of the considered corpus delicti. The subject of our study are certain problematic aspects of the activity for the disclosure and investigation of crimes under Art. 260 of the Criminal Code of the Russian Federation. The object of the study is the activities of the internal affairs bodies for the disclosure and investigation of crimes under Art. 260 of the Criminal Code of the Russian Federation. The need to improve this area of work of the internal affairs bodies is due to the imperfection of the legal framework, on the one hand, and the increased criminal attention to the area of timber production, on the other. Theoretical, methodological and comparative analysis of domestic sources was used as the main research method. The scientific novelty of this work lies in the identification of problematic aspects of criminal, criminal procedural and operational-investigative legislation in the field of combating illegal logging of forest plantations. The results of the study necessitated a differentiated approach to different types of illegal logging of forest plantations. The author cites various typological types of illegal logging and, on the basis of this, proposes specific operational-search and criminal procedural measures to counter these crimes. As the main conclusions, it should be noted that the difference in the operational - search and procedural aspect of various groups of crimes related to illegal logging of forest plantations causes a difference in approaches to counteracting them.
