В статье рассматривается вопрос, посвященный возможности отнесения оперативно-розыскной деятельности к самостоятельной отрасли российского права. С позиции общей теории права применительно к оперативно-розыскной деятельности анализируются такие признаки отрасли, как предмет и метод правового регулирования. Рассмотрение элементов предмета оперативно-розыскных правоотношений и выделение методов их правового регулирования определили вывод о возможности выделения оперативно-розыскной деятельности в отдельную отрасль права.
This article is about issue of possibility of reference of operative-investigatory activity to independent branch of the Russian law. The author analyzes such signs of branch of law as a subject and a method of legal regulation from the point of view general theory of law with reference to operative-investigatory activity. The author has considered the elements of a subject of operative-investigatory legal relations, has allocated the methods of its legal regulation and has come to conclusion about possibility of reckoning of activity operative-investigatory among separate branchs of law *.
